Labour law
I have built up considerable consulting expertise in national and international labour law issues. Not only do I offer my clients well-founded legal advice, I also assist them in developing tailor-made solutions for their practical problems in all areas of individual and collective labour law. When consulting my clients, I include advice on relevant aspects of company law, social security law and tax law.
My consulting services in the area of labour law are focused on the following:
- Preparation of employment contracts, both for “normal” employees and managers
- Preparation of other labour law contracts (freelance contracts, contracts for work and services, etc. )
- Preparation of contracts and consulting regarding foreign assignments of employees and/or the employment of foreigners in Austria
- Advice on the employment of external personnel, including without limitation, issues regarding the Austrian Law on the Placement of Temporary Personnel (“ Arbeitskräfteüberlassungsgesetz ”)
- Advice on the termination of employment (termination, dismissal, retirement); preparation of termination agreements taking into account aspects of tax law and social law
- Assistance of companies in restructuring measures (starting from the decision on the legal form up to the negotiations with the works council) and their implementation in the form of individual contracts and works constitutions
- Due diligence reviews in preparation of the sale or acquisition of companies
- Advice to the person selling and/or taking over the business in the cases of company sales and purchases and outsourcing; handling of the take-over of businesses avoiding the transfer of ownership
- Development and implementation of working time models
- Drafting of clauses of non-competition during and after termination of employment
- Advice on company pension schemes; review and enforcement of specific individual claims
- Advice on and development of employee profit-sharing schemes, including without limitation, stock option plans
- Advice on and preparation of agreements between the employer and the works council (including social compensation plans)
- Representation in labour and social courts
- Organisation of tailor-made seminars for personnel and legal departments and for the management of companies in all areas of individual and collective labour law
